Education Law Section 2-D provides guidance to educational agencies and their third-party contractors on ways to strengthen data privacy and security in order to protect student personally identifiable information (PII) from unauthorized disclosure. Additionally, this law provides parents with rights regarding their child's PII.

FEDERAL LAWS PROTECTING STUDENT DATA & RIGHTS

The Family Educational Rights and Privacy Act (FERPA) is the foundational federal law on the privacy of students’ educational records. FERPA safeguards student privacy by limiting who may access student records, specifying for what purpose they may access those records and detailing the rules that must be followed when accessing student data.

FERPA ANNUAL NOTIFICATION


The Protection of Pupil Rights Amendment (PPRA) defines the rules states and school districts must follow when administering tools like surveys, analysis, and evaluations funded by the US Department of Education to students. It requires parental approval to administer many such tools and ensures that school districts have policies in place regarding how the data collected through these tools can be used.

FERPA gives school districts the option of designating certain categories of student information as directory information. This information may be released by the district to third-parties, such as companies that manufacture class rings and/or publish yearbooks, without prior authorization or consent for each individual request.

Parent(s)/guardian(s) and eligible students who DO NOT consent to have directory information released or published must complete the form below and return it to the Building Principal by the close of business on the last school day each September. Notifications received after the specified deadline shall be accommodated to the greatest extent possible from the time they are received.


Unauthorized Disclosure Complaints/Incident Reporting

Parents/guardians and others who have concerns or wish to file a complaint about possible breach or improper disclosure of data may do so using the KPCSD Incident Reporting Form.

Individuals have the right to file a complaint with the U.S. Department of Education concerning alleged failures by the District to comply with the Student Privacy requirements of FERPA.  The name/address of the office that administers FERPA is:

If at any time district officials learn that student and/or teacher/principal data has been compromised, parents and guardians will be notified and the data breach will be reported to the New York State Education Department.
